The firms ethos of closely integrated teams means that we are ideally placed to attend to the diverse needs of the charities for whom we act, including both those needs specifically arising out of charitable status and those common to the many other commercial and public sector entities for whom we act, including:

  • Buying, selling or letting premises;
  • Advising in connection with changes of ownership of properties and businesses; and
  • Ensuring compliance with the Companies Acts and charities regulation where applicable.

Our charitable clients can call upon the experience of our business and property solicitors, Jamie McEwen, Naren Deen and Graham Barnard each of whom will take time to understand our clients businesses and the issues facing them in order to seek to provide a commercially valuable legal solution, rather than simply a standard black letter legal response.  We also recognise that charities, like all businesses, have finite resources and, to this end, we endeavor to provide real value for money.

Our charitable clients can also be reassured that if an employment matter or a dispute arises in respect of which legal advice is required, we can call upon  the considerable expertise of our Litigation and Employment teams with a view to promptly resolving the matter.

We also have experience of:

  • Preparing and advising upon the governing documents of charities (including the Articles of Association of charitable companies);
  • Setting up new companies limited by guarantee (in partnership with company formation agents) that may be used as charitable vehicles;
  • Advising upon the statutory requirements relating to disposals of charitable assets (including but not limited to land);
  • Applying to the Charity Commission for its consent to the proposed actions of charities where such consent is required; and
  • Attending to registration of charities with the Charity Commission.

Our involvement with charities is not simply limited to legal advice.  We actively support and carry out fundraising activities for the benefit of local charities, including two which have been chosen by a poll of our staff.
