Claim against ex-husband allowed – 23 years after divorce

As no final financial settlement was reached following the divorce, the Supreme Court have ruled that the ex-wife can now bring a claim – although unlikely to receive the £1.9 million she has asked for, it is conceivable that she will receive a substantial sum.

This case highlights the importance of ensuring good advice is received during a divorce. The involvement of a solicitor could have ensured that a final settlement was put in place, and any future claims could have been prevented. Without this being done, this ruling shows that divorced couples can be vulnerable to claims many years after the divorce – and regardless of when any wealth was acquired.
