Property

Whether you are a state-maintained school, an Academy or another type of school or educational body, if you require legal advice in connection with property matters, we would love to work with you.

The Firm currently advises a variety of types of school across the north of England, but is not limited in its offering by geographical considerations.

The Property department is headed by Robert Gibson a solicitor with over 30 years experience.  Day-to-day, property matters are dealt with on behalf of our educational clients by Jamie McEwen, who is ably assisted by Robert and David Laud who heads the Education team.

If your matter requires it, the Property department can call upon the expertise of the Firms Construction or Litigation departments to further enhance our offering to you.

The Firm has gained its expertise in the educational arena by advising a number of schools in connection with their conversion to Academy status.  We have advised our educational clients in connection with wide variety of matters, including, but not limited to:

  • the legal implications in respect of the land and buildings occupied and used by them of converting to Academy status;
  • structuring property arrangements on conversion to Academy status to prevent the transfer from a local authority of potentially large clawback liabilities for past grants made in respect of land and buildings occupied by our client; and
  • advising our clients in relation to the grant of underleases of parts of school buildings back to the local authority.
